DIPLOMACY BEFORE LITIGATION

Because we offer a variety of services that complement each other, we can look at your business and know that every legal issue has the potential to impact another part of your business or even your personal life. Unlike many firms, we believe in pursuing effective strategies to resolve the issue before it comes to filing a lawsuit.

Litigation can be very costly to both parties, sometimes more than the value of the contract and is often wholly unnecessary. Through skilled mediation and negotiation, we often settle lawsuits prior to trial, saving our clients considerable amounts of time and financial resources. The objective is to craft a win-win deal for both parties and net out more money in our client’s pockets.

WHEN IT COMES TO LITIGATION, WE KNOW CALIFORNIA LAW

If other options are exhausted and the issue requires litigation, we are experienced and committed to protecting and preserving your rights. We’ve been litigating and doing trial work in both state and federal court for more than 35 years. If another area of your business is affected, you have seasoned attorneys with different specialties at your disposal—with full interaction between our practice areas.

THE RIGHT REMEDY FOR THE PROBLEM

Your business is damaged when someone fails to fulfill his or her end of a contract. These kinds of damages are usually not just limited to the value of your contract – it often means hurting your business in the form of lost future profits, or damaging customer relationships. Our experienced business lawyers can help you recover these damages.

CASE STUDY: PROPERTY OWNER SUED FOR ENVIRONMENTAL CLEAN UP COSTS

Our client, the former property owner, was being sued for approximately $1 million by the new property owner for environmental contamination clean-up costs. Our thorough research uncovered 40 other companies that had brought contaminants to the property and who were also liable for clean-up costs.

Through negotiation, we were able to have the 40 other companies agree to contribute 50% of the $1 million. We were able to settle the case in one round, with virtually no litigation costs. This is how we used collaboration and mediation to produce a far superior result than protracted litigation with everyone involved.

FAQs

What Is General Business Litigation?

Litigation is the process of resolving a legal case in the courtroom. General business litigation can involve the resolution of a dispute between businesses and other parties or defending a business against allegations of wrongdoing.

Your company could face litigation if you become involved in a civil dispute with a current or former employee, a partner business, or an intellectual property dispute. Criminal cases may arise if a business is accused of wrongdoing, if a business owner leverages company assets for illegal reasons, or if a business is found out of compliance with important regulations.

Artiano & Associates can provide the litigation support needed to prevail on or resolve the business dispute.

How Can You Defend Your Business from a Lawsuit in California?

One of the most effective ways to defend your business from any type of lawsuit in California is to hire the right attorney.  Having Artiano & Associates as your business law and business litigation attorneys will provide you with comprehensive support through all phases of the case.

If you already have an in-house legal department, we also act as outside counsel alongside them to and alleviate your stress and allow you to focus on your usual responsibilities while also providing unique insights. If you do not have in-house counsel, working with our firm is of paramount importance if you encounter any type of legal matter that could jeopardize the future of your organization.

What Is the Difference Between Business Law and Business Litigation?

The difference between business law and business litigation is that “business law” is a very broad term that can apply to any legal matter pertaining to the formation, operation, closure, or merger of a business. Business law includes maintaining regulatory compliance, creating legally enforceable contracts and agreements with various parties, establishing corporate governance, and protecting the business’s intellectual property.

“Business litigation” refers to the resolution of a dispute between business entities or defending a business from allegations of wrongdoing in the court system. Business law is a broad area of law that encompasses many important facets, while business litigation is an active process aimed at resolving a specific legal matter.

Is Litigation or Arbitration Better for My Business?

Whether litigation or arbitration is better for your business can vary. There are potential benefits and drawbacks with either choice. In a complex case, litigation can ensure a more thorough evaluation of the facts, but the process is open to the public. Sensitive aspects of your operation could be exposed, and the case may cause reputational harm even if you did nothing wrong.

On the other hand, arbitration is private and can be binding, allowing for more protection of sensitive company information but with less flexibility. Artiano & Associates can advise you as to which option would better suit your interests if given the choice.
